Five Justices Listen to the States, Support a Federal Role in Clean Water Protection

In the recent decisions in Rapanos v. Unites States and Carabell v. U.S. Army Corps of Engineers, five justices reaffirmed broad protection for rivers, streams, and wetlands under the Clean Water Act. They recognized that States, working alone, are powerless to stop pollution that originates beyond their borders, and need the backdrop of federal protection to preserve their lakes, rivers, and streams.Click here for more
